Carl Schmitt veröffentlichte einen Großteil seiner wichtigen Werke im Verlag Duncker & Humblot. Im Zuge der engen Zusammenarbeit mit dem damaligen Verlagsleiter Ludwig Feuchtwanger entwickelte sich ein reger intellektueller, anspielungsreicher Austausch auf Augenhöhe zwischen Autor und Verleger. Ludwig Feuchtwanger, ein heute nahezu vergessener Intellektueller der jüdischen Renaissance nach dem Ersten Weltkrieg, vermochte es, auf Schmitts Interessen einzugehen und diese z.T. zu lenken. Dieser nun erstmals edierte Briefwechsel zeichnet ein Bild zweier Gelehrter in der Weimarer Republik, veranschaulicht u.a. (...) auch die materielle Lage eines wissenschaftlichen Autors und gibt Einblick in den damaligen Buchmarkt. Daneben finden sich Bausteine zur Biographie Carl Schmitts und Ludwig Feuchtwangers sowie ihren intellektuellen Netzwerken. Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die Schreiben (...) Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. _Slow Cures and Bad Philosophers_ uses insights from the philosophy of Ludwig Wittgenstein to rethink bioethics. Although Wittgenstein produced little formal writing on ethics, this volume shows that, in fact, ethical issues permeate the entirety of his work. The scholars whom Carl Elliott has assembled in this volume pay particular attention to Wittgenstein’s concern with the thick context of moral problems, his suspicion of theory, and his belief in description as the real aim of philosophy. Their aim is (...) not to examine Wittgenstein’s personal moral convictions but rather to explore how a deep engagement with his work can illuminate some of the problems that medicine and biological science present. As Elliott explains in his introduction, Wittgenstein’s philosophy runs against the grain of most contemporary bioethics scholarship, which all too often ignores the context in which moral problems are situated and pays little attention to narrative, ethnography, and clinical case studies in rendering bioethical judgments. Such anonymous, impersonal, rule-writing directives in which health care workers are advised how to behave is what this volume intends to counteract. Instead, contributors stress the value of focusing on the concrete particulars of moral problems and write in the spirit of Wittgenstein’s belief that philosophy should be useful. Friedrich August von Hayek war ein österreichischer Ökonom und Philosoph. In Wien in eine Familie von Akademikern hineingeboren, studierte Hayek zunächst Rechtswissenschaften an der Universität Wien, zeigte aber auch großes Interesse an Psychologie und Volkswirtschaftslehre. So nahm er regelmäßig an Seminaren von Ludwig von Mises Teil und wurde 1921 in Rechtswissenschaften und 1923 in Staatswissenschaften promoviert.

Ludwig Wittgenstein's _Tractatus Logico-Philosophicus_ and _Philosophical Investigations_ are among the most influential philosophical books of the twentieth century, and also among the most perplexing. Wittgenstein warned again and again that he was not and would not be understood. Moreover, Wittgenstein's work seems to have little relevance to the way philosophy is done today. In _Wittgenstein in Exile_, James Klagge proposes a new way of looking at Wittgenstein -- as an exile -- that helps make sense of this. Wittgenstein's exile (...) was not, despite his wanderings from Vienna to Cambridge to Norway to Ireland, strictly geographical; rather, Klagge argues, Wittgenstein was never at home in the twentieth century. He was in exile from an earlier era -- Oswald Spengler's culture of the early nineteenth century. Klagge draws on the full range of evidence, including Wittgenstein's published work, the complete Nachlaß, correspondence, lectures, and conversations. He places Wittgenstein's work in a broad context, along a trajectory of thought that includes Job, Goethe, and Dostoyevsky. Yet Klagge also writes from an analytic philosophical perspective, discussing such topics as essentialism, private experience, relativism, causation, and eliminativism. Maria Kokoszyńska-Lutmanowa (1906-1981) was a Polish philosopher and student of Kazimierz Twardowski, the founder of the Lvov-Warsaw School. In 1938 she went to the University of Cambridge (Newnham College) on a Sarah Smitton Fellowship. There she attended George Edward Moore’s lectures as well as one of Ludwig Wittgenstein’s Lectures on the Foundations of Mathematics in 1939. In this interview which was conducted with Alois Eder she talks about her encounter with Wittgenstein. It was published in 1978 in the Polish (...) art and culture magazine Odra and is her only published memoir about Wittgenstein. Ludwig Wittgenstein gave priority to aesthetics over other disciplines due to its invaluable capacities for revealing certain aspects of the nature of human understanding and for guiding our actions toward an ethical life. Although Wittgenstein did not focus on these issues in a systematic way, these worries were present in his philosophy during his lifetime. That is why I use a very wide range of his writings, from the Tractatus to letters and diaries. Aesthetic inquiries can throw light upon (...) the existence of an intransitive understanding–that is, a kind of knowledge that cannot be expressed by language shared by all competent users of a language. I also discuss Wittgenstein’s conception of ethics in order to explain the close relationship that he proposed between ethics and aesthetics. I hope this will clarify why he believed there was so much to learn from paintings, films, music, poems, or novels. I compare works of art and religious belief and how the former can help us to guide our lives as the latter does. I do this while extending the scope and claiming the importance of aesthetic education, given that it can help us to deal with our nature and with our history. (shrink)

This essay points out the great importance of the recently published exchange of letters between Carl Schmitt and his publisher Ludwig Feuchtwanger. Using unknown letters, it also outlines Schmitt's relationship with Jewish intellectuals before 1933, describes the dramatic development of the political-theological controversy, and honors Feuchtwanger as a postassimilationist Jewish intellectual and legal historian.

Bazzocchi disposes the text of the Tractatus in a user-friendly manner, exactly as Wittgenstein's decimals advise. This discloses the logical form of the book by distinct reading units, linked into a fashioned hierarchical tree. The text becomes much clearer and every reader can enjoy, finally, its formal and literary qualities.

Adam Smith said that ‘the propensity to truck, barter and exchange one thing for another is common to all men, and to be found in no other race of animals.’ Smith addressed the mark of the man economical, and there is no denying that this is the peculiar way he acts: clearly, to truck, barter and exchange is to act in a certain way. Austrian economics adopts this way of looking at the realm of economics. It prides itself as a (...) theory of human action. This claim seems ill-founded as long as so important a contribution as Ludwig von Mises’s praxeology remains insufficiently understood. In this paper, I address Barry Smith’s charge that in praxeology ‘other core notions, in addition to the concept of action, have been smuggled into and the theory is therefore not purely analytic’. I offer logical proofs of two cornerstone theorems of praxeology, the uneasiness theorem and the scarcity theorem, and thus provide vindication. Also, the findings support Mises’s controversial claim that economics is a priori founded in action theory. Thus, Carl Menger’s dream to lay foundations to economics and the other social sciences may have come true in the guise of praxeology. (shrink)

Carl F. Craver investigates what we are doing when we use neuroscience to explain what's going on in the brain. When does an explanation succeed and when does it fail? Craver offers explicit standards for successful explanation of the workings of the brain, on the basis of a systematic view about what neuroscientific explanations are.

Under what conditions are people responsible for their choices and the outcomes of those choices? How could such conditions be fostered by liberal societies? Should what people are due as a matter of justice depend on what they are responsible for? For example, how far should healthcare provision depend on patients' past choices? What values would be realized and which hampered by making justice sensitive to responsibility? Would it give people what they deserve? Would it advance or hinder equality? The (...) explosion of philosophical interest in such questions has been fuelled by increased focus on individual responsibility in political debates. Political philosophers, especially egalitarians, have responded to such developments by attempting to map out the proper place for responsibility in theories of justice. This paper aims to contribute to an ongoing and controversial debate about non-conceptuality in Kantian aesthetics. It is a replica on a paper of Dietmar Heidemann in Con-Textos Kantianos N.° 12, to which I do consent, but I’d like to give some additional comments on a specific issue: I show in this paper that the problem about whether or not the understanding contributes to aesthetic judgment can be elucidated by means of a revaluation of the imagination’s capacity of formal representation (...) and the subsuming activity of the power of reflective judgment. I argue that the understanding is considered by the power of reflective judgment merely in his lawfulness in order to find a universal under which the imagination’s particular, the formal representation of the beautiful shape, can be subsumed. Philosopher Ludwig Wittgenstein had an enormous influence on twentieth-century philosophy even though only one of his works, the famous Tractatus Logico-Philosophicus, was published in his lifetime. Beyond this publication the impact of his thought was mainly conveyed to a small circle of students through his lectures at Cambridge University. Fortunately, many of his ideas have survived in both the dictations that were subsequently published, and the notes taken by his students, among them Alice Ambrose and the late Margaret Macdonald, (...) from 1932 to 1935. These notes, now edited by Professor Ambrose, are here published, and they shed much light on Wittgenstein's philosophical development. Among the topics considered are the meaning of a word and its relation to common usage, rules of grammar and their relation to fact, the grammar of first person statements, language games, and the nature of philosophy.
